Contract for Non Refundable Puppy Deposit Agreement 

                          

The buyer, ________________________________________ agrees to place a NON REFUNDABLE deposit

 on the puppy of their choice, (In the order that deposits are received is the order that pick of the litter will go. You will be able to choose your puppy between the age of 4 - 5 weeks old.) The puppy shall remain with “Breeder” until the puppy is at least 8 weeks old and no older than 10 weeks old unless noted in this contract.

 

 BUYER: I am aware that my deposit amount of $ 200.00  is non refundable, should I decide I do not want or am unable to take said puppy.

 

There are no refunds on Deposits, unless otherwise agreed here in writing.   Failure of the Buyer to complete this purchase would subject Seller to lost opportunities to sell the Puppy to some other Buyer and retention of the Deposit is meant to compensate Seller for their possible loss. This deposit signifies the intent on the part of the Buyer to follow through with the Purchase of this Puppy.

 

Please note what ever money you send towards the purchase of the puppy is NON-refundable.

 

The Seller reserves the right to void this transaction and refund the Deposit if we learn of any reason why Buyer might not be suitable for the puppy –( i.e. Buyer is found to be an animal abuser, violent person, representative of a Pet Store, representative of a pharmaceutical research laboratory etc.)  

 

If the transaction is voided or if through some tragic accident the Puppy were to die or otherwise be seriously injured before it goes to its new home then, of course, the deposit will be returned to the Buyer; unless the Buyer wishes to apply the Deposit to another Puppy, if one is available, or to a puppy from the next available litter.

 

BREEDER: I will accept this deposit amount of $ 200.00 to hold said puppy until it is at least 8 weeks old and no older than 10 weeks, unless otherwise agreed upon on pickup date of puppy.

 

Please note that determining a puppies coat length any younger than at least 4 weeks of age cannot be guaranteed. If you are placing a deposit on a puppy who's coat length is undetermined, your deposit cannot be returned because the coat is not what you wanted.

HEALTH GUARANTEE

The Seller, guarantees Your Puppy to be free from infectious diseases for 4 days after the puppy leaves our premises and guarantees the Puppy to be free from genetic problems for up to one year of age.  Hip and joint problems can be caused by or influenced by overfeeding, improper diet,  failure to maintain proper weight, failure to provide sufficient exercise, over-exercising or improper exercising  which would be out of our control. 

The guarantee of the hips does not cover problems that are environmentally induced.  The purchaser should take great care in bringing up the Puppy.  The Puppy should not be allowed to jump from great heights taller than himself (for example avoid jumping off a porch or out of a truck), or run up and down stairs or do a lot of running and sliding on slick surfaces or be subjected to strenuous exercise.  Before a pup reaches about age 15 months, his tendons are not strong enough to bear weight from impact… lax tendons allow the head of the hip bone to bang into the hip socket causing trauma to cartilage and bone.  This can cause hip dysplasia and elbow problems.  Seller will not be responsible for this kind of damage.  Should the Puppy develop hip dysplasia even after proper care and proper food, then the pup will be replaced with a pup of equal or greater value from the next litter.  We will not replace a pup until we have received a copy of the x-rays accompanied by a letter from the vet.   This letter should also include proof of regular vet visits that documented a healthy maintained weight up until the diagnosis of HD.  After we have reviewed the x-rays, we reserve the right to forward the x-rays to our Vet or to OFA for further evaluation before the pup is replaced.  We will replace a pup only once..as such an occurance is highly unlikely in the first place if proper care is given.  This replacement does not include the cost of transportation or medical-related expenses. 

We do not guarantee temperament.  We  bred only from dogs that have demonstrated great stable temperament.   All our Puppiess are temperament tested and sound when placed in their new homes.  We take great pains to provide a secure, loving environment for our Puppies from birth and provide daily proper socialization.   After placement,  the responsibility is on the Buyer to provide a good environment with proper socialization.  It is the Buyer’s responsibility to keep the Puppy free from harm and bad interactions with other people, dogs and animals.  Any negative exposure of the puppy to a bad experience with other dogs or people can cause lasting effects.  Be gentle with your Puppy and use Positive Reinforcement ( Praise him when he does “good” -  ignore his mistakes, don’t overuse the words “No” or “Nein”)  to train him.  Do NOT hit your puppy or do silly things like rub his nose in urine or feces “accidents”. 

The buyer agrees to keep the Puppy healthy, maintain and stay current with all puppy vaccinations, provide periodic vet checks including an initial examination within the first 4 days after delivery, and to keep the pup at a healthy Lean weight by feeding a quality dog food.  A fat puppy is an unhealthy puppy. 

Seller will provide Buyer with a puppy that leaves Arwen of The Unega Waya: clean, in good general health and that has no known physical defects.  De-wormings and first immunizations will have been completed. We vaccinate our puppies between 7-8 weeks of age.  It is generally recognized that intestinal parasites (worms etc) are common in puppies, and are a part of a puppy’s early development but we will make every effort to prevent parasites.  Often, however, the stress of change and travel can cause intestinal parasites to emerge.  Buyer agrees to continue parasite testing and treatment (if necessary) with their veterinarian. 

Buyer agrees that he/she will take their puppy to their veterinarian within 4 days of receiving the Puppy for examination, testing for worms, treatment for worms, obtain prescription for Heartgard and Frontine and to schedule ongoing immunizations as recommended.   If the purchaser’s veterinarian finds the puppy to be in poor health, the veterinarian’s written description of the problems must be provided, dated within 4 days of the date the Buyer received their puppy.

 Genetic defects are covered by this guarantee including hips for 1 year.  A written examination from a veterinarian must state that genetic defect exists and be accompainied by x-rays and other testing as appropriate. 

We have a 1 yr *serious genetic warranty with our puppies. We do not warranty for anything that the puppy can catch as that is out of our control. 

*Serious genetic defect is one that will shorten the lifespan of the puppy or deem the puppy to be a medical haphazard and require continued health care. Undescended testicle, ear not standing, coat not long enough, over bite/underbite (unless affects dogs ability to chew food properly), or the dog did not get as big as buyer had hoped are NOT covered in the serious genetic warranty.

Buyer must have documentation by a licensed veterinarian,  that is dated within 4 days of Buyer’s receipt of the Puppy,  that shows serious untreatable infectious illness or genetic defect which is sufficiently serious in the opinion of two qualified veterinarians, at least one of whom is selected by the Seller, to warrant euthanization of the dog, Buyer will be refunded 1/2 of the price of the Puppy or given a replacement Puppy from the Seller’s next available litter.  Transportation costs (if any) will not be refunded and are not included in this guarantee.  

Expenses of treatment, exams and tests are the financial responsibility of the Buyer.  

Buyer agrees to keep their puppy at home and away from other dogs, public places, parks and will use care in allowing others from ouside their home to pet or touch the puppy.  This is to protect the puppy from exposure to parvovirus and other infectious illnesses.

Should the hips by one year of age show to be anything less than fair, then 1/2 of the purchase price of puppy shall be returned.

With the changes in the economy, all monies may not be returned in one lump sum but rather be done in installments at the sellers discretion.

 

Seller reserves the right to have said puppy returned to us under the following conditions and either half of the puppies purchase price or no refund at all shall be given depending on severiety of the case. The following are grounds for Seller to remove said puppy , with all cost for removal and obtaining custody back to Seller falling on the Buyer:

  • If puppy is found to be used for Breeding in any way when puppy has been purchased under a Pet Purchase
  • If puppy is found to be living outside on or off a chain
  • If there is any reason to believe at our discretion that puppy has been or is being abused, mistreated or any other cruelty such as a lack of proper food, shelter or vetting.
  • If anyone is found to have resale, traded ,flipped, turned puppy into a shelter or sold puppy to a pet store

 

*If any leagle fees shall apply (because of broken contract) Buyer will be responsible for all parties.

 

GENERAL

This written Agreement contains all of the terms of this Sales Agreement.  No refunds will be given, all deposits are non-refundable and all sales are final.

 

***BREEDING RIGHTS

We will sell some of our puppies with full breeding rights. Breeding rights can be limited at our discretion. If you want a dog for breeding you must purchase the dog with full registration. Not all dogs will be sold with full registration so please be sure to ask if you are interested in breeding.

What's the difference between Full and Limited registration (Pet Purchase)?

Reputable breeders breed for the improvement of the breed and only breed what they consider to be the best breeding stock. This is protecting the name of the kennel and the integrity of the breeding program by not permitting offspring of these pet quality dogs being sold.

 

*Seller reserves the right to hold Registration papers for Puppies being purchased as Pet Purchase until said puppy has been altered between 4 months and 1 year of age.

Papers will be supplied when buyer has shown proof from a Certified Veterianarian by a signed document stating that said puppy has been altered.

 

 Said dog is purchased “AS IS” and Seller does hereby disclaim any and all other warranties, whether expressed or implied, except those described above or attached. Upon signing of this agreement, both parties agree that they have read and fully understand this agreement.
